Bookings & Cancellation Policy
- Course numbers are limited to ensure maximum personal attention for all candidates. Places are allocated in order of receipt of a completed registration form, with cleared payment.
- If you register for a course that is fully subscribed, we will add you to our waiting list. Should a place later become available on that course, or on a subsequent one, we will contact you directly.
- Booking forms are not considered complete without a valid and confirmed (cleared) payment.
- All bookings must be accompanied by the full course fees. Accepted method of payment is by cheque (or cash for in-person bookings only), for alternate methods please contact Beyond The Blue Limited directly. All cheques should be made payable to Beyond The Blue Limited. If your company wishes to be invoiced for the course you are attending, please write to us on your company headed paper and send an official company purchase order with your booking form (subject to credit checks). Your place on the course cannot be guaranteed until full payment / official order is received.
- Until the point of receiving an official order form (corporate customers) / completed booking form (private customers) from the client, no fee is due.
- As soon as possible after you register, we will send you confirmation of a place on a course, together with the date, time, location and your booking reference.
- If there are places available on a course we will accept bookings right up until the course commences* (*subject to booking conditions. This service will not be available on some courses due to the terms and conditions of the accrediting bodies). However, please note that for applications made within 5 working days of the start of a course we cannot guarantee that your booking confirmation will reach you by post prior to the start of the course. Our policy is to inform late applicants if they have a place on the course by telephone or email. If however you make a late application for a course and do not receive a letter or telephone call from us within 24 hours to confirm your place, it is your responsibility to Contact Us at Beyond The Blue Limited to check on the status of your booking.
- Your booking is made with Beyond The Blue Limited. When booking you guarantee that you have the authority to accept and do accept on behalf of you / your company / your organisation the terms of these booking conditions and the booking conditions of any contract principals where we are acting as agent.
- By making this booking you agree; that we may pass any information you provide on to the relevant authorities such as local authorities, awarding bodies, etc. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or as required by law. Information is only passed on where it is a requirement by law or to satisfy awarding bodies. Information is not passed to commercial partners or third parties for commercial reasons.
- A contract will exist as soon as payment has been accepted, an official order has been received (corporate clients) and a confirmation invoice has been issued. These booking conditions form part of your contract with us. This contract and any matters arising from it are governed by English Law and we both agree to submit to the jurisdiction of the English courts. You may, however, choose the law and jurisdiction of Scotland or Northern Ireland if you wish.
- Candidates registering for a course or service, who will be under the age of 18 at the time the course is run, must provide the written permission of the parent or legal guardian.
- Candidates are responsible for the accuracy of all administrative details when registering for the course or service and during all administrative processes relating to the course or service being provided. Errors and omissions may result in delays and examinations being declared void by Beyond The Blue Limited or the examinations / accrediting bodies.
- Courses are run in accordance with the Beyond The Blue Limited Equal Opportunities Policy, Health & Safety Policy and Quality Assurance Manual.
Refunds:
- On receiving an official order / completed booking form from the client, the client is bound by the following terms of cancellation:
a. More then 2 calendar months prior to the course date 80% Refund offered*
b. More then 28 days prior to the course date 50% Refund offered*
c. More then 14 days prior to the course date 30% Refund offered*
d. Less then 14 days prior to the course date 0% refund offered
*Once a candidate is registered to sit the examination with the awarding body, no refund is given for examination and course material fees.
- Once booking has been accepted with a completed and signed booking / order form, no refunds for candidate’s / client’s failure to attend will be offered. All candidates must attend ALL sessions of the training in order to complete the course. Failure to do so will result in certificates not being awarded and the student will not be eligible to sit the exams. No refund is offered for any student who fails to pass any of the exams for the course they are attending.
- Candidates are responsible for ensuring they are eligible for and meet the criteria required in order to complete the courses, examinations and services offered by Beyond The Blue Limited. Failure to meet those requirements may result in courses and services being withdrawn and the refund policies being enacted by Beyond The Blue Limited.
- Beyond The Blue Limited reserves the right to refuse access to its services and courses for anyone it deems to have breached our codes of practice or who acts in a disruptive or threatening manner towards any other person. No refunds are given for any person legitimately removed from any event, service or course.
- Notification of any cancellation must be made in writing quoting the Client Booking Number.
- If no written cancellation is received prior to the course in line with the refund policy and the participant does not attend on the day(s), then the participant is liable for full course fees.
- Except where otherwise expressly stated in these booking conditions, we regret we cannot accept liability or pay any compensation where the performance or prompt performance of our contractual obligations is prevented or affected by, or you otherwise suffer any damage or loss as a result of, “force majeure”. In these Booking Conditions, “force majeure” means any event which we or the supplier of the service(s) in question could not, even with all due care, foresee or avoid. Such events may include war or threat of war, riot, civil strife, terrorist activity (actual or threatened), industrial dispute, natural or nuclear disaster, adverse weather conditions, fire and all similar events outside our control
Transfer of Candidates:
- Should the participant be unable to attend, a substitute nomination is welcome. A transfer of course registration can be made at any time up to 7 days prior to the course date* (*Except for the BIIAB accredited courses. No transfers can be made at any time.). Advice must be in writing and directed to Beyond The Blue Limited and must arrive at least 7 days prior to the course. Each transfer will attract a £20 administration fee.
VAT:
- All orders are subject to VAT at the current rate at the time of invoice.
Cancellation and Postponement:
- Beyond The Blue Limited reserves the right to cancel/postpone courses / services, change course location, substitute lecturers and tutors, in the event of unforeseen circumstances or insufficient registered candidates. Every effort will be made to ensure that participants of cancelled courses are placed on the next available course.
- Where a course is cancelled by Beyond The Blue Limited and you, as the participant elects not to be placed on the next available course you will be notified as quickly as possible. You will be given the opportunity to transfer to another course; otherwise the full cost of your fees will be refunded to you within three weeks under normal conditions. We shall not be liable for any other consequential loss.
Course Costs:
- Booking fee covers the course costs only and where applicable examination fees. Candidates are responsible for the cost of any accommodation, refreshments and meals they require for the duration of the course.
- Certain courses may require candidates to purchase manuals or other training materials. Training materials are included in the course fee unless advised in the booking form as a specified additional cost.
- Course fees do not include any external applications for licensing purposes such as the SIA Door Supervisors badge. Where further costs are incurred for a license application purposes, these are not covered by the course fee and remain the responsibility of the candidate.
- Discounts and promotions are controlled by the separate “Discounts & Promotions Terms & Conditions”
Images and Copyright:
- Beyond The Blue Limited may take photographs during the provision of services it offers. Beyond The Blue Limited reserves the right to use these images for promotional purposes without consent. Candidates and individuals may choose to request that any photographs used do not portray their image and request that their image be removed from any marketing materials. But unless this request is made Beyond The Blue Limited reserves the right to utilise these images. Beyond The Blue Limited will commit to removing any images following a written request within a reasonable time frame. Please note that printed materials will continue to be used while stock last and images will be removed from future print runs.
- Candidates and members of the public can request that their image not be used or photographed prior or at anytime during and following the delivery of a course or service.
- Candidates may not use still or video cameras for the duration of any presentation or course provided by Beyond The Blue without prior permission. No portion of any documentation or training materials may be copied or reproduced without prior consent of Beyond The Blue and remains under copyright by Beyond The Blue Limited.
- The corporate identity and Logo of Beyond The Blue Limited remain the property of Beyond The Blue Limited and are protected by copyright and trademark law. These may not be reproduced, used or represented without the express permission of Beyond The Blue Limited.
Information, Brochure and Website Accuracy:
- Please note, the information and prices shown on our website (www.beyond-the-blue.co.uk) and in our brochures may have changed by the time you come to book your course/service. Whilst every effort is made to ensure the accuracy of the website, brochure and prices at the time of publishing, regrettably errors do occasionally occur. You must therefore ensure you check all details of your chosen service (including the price) with us at the time of booking. The website and our brochures are our sole responsibility. They are not produced on behalf of and do not commit any independent organisation/companies whose services are featured in it.
Liability and Accountability:
- Beyond The Blue Limited accepts no responsibility for the actions of any individual following training that fall outside of the UK law and leads to injury to themselves or a second party. Training is given as guidance and individuals remain responsible to act within that guidance and remain responsible for their own actions at all times.
- We would remind individuals that the English Law takes precedent over any guidance given and Beyond The Blue Limited expects that anyone following guidance keep their actions within the law of the English Courts at all times. We will not assume any liability or responsibility for any actions that place individuals, companies and organisations outside of English Law.
- Bookings are accepted on the understanding that all persons taking part in activities, courses and services are normally in good health and able to fulfil the physical demands of the chosen course / service. In the interests of safety, you must follow the guidance in our notes, as well as that provided by anybody on our behalf; comply with any local codes of conduct, follow the country code, and act sensibly and prudently at all times. It is your responsibility to ensure that you are in possession of all necessary documentation.
- All courses are taught in English. Applicants whose first language is not English should note that they are required to be proficient in written and spoken English and be able to participate in group discussions and presentations in English.
- When you book with us, you accept responsibility for any damage or loss caused by you or any member of your party. Full payment for any such damage or loss must be paid directly and at the time to the owner or manager or other supplier. If you fail to do so, you will be responsible for meeting any claims subsequently made by us and against us (together with our own and the other party’s full legal costs) as a result of your actions.
- We expect all clients to have consideration for other people. If in our reasonable opinion or in the reasonable opinion of any other person in authority, you or any member of your party behaves in such a way as to cause or be likely to cause danger, upset or distress to any third party or damage to property, we are entitled, without prior notice, to terminate inclusion in any course or service of the person(s) concerned. In this situation, the person(s) concerned will be required to leave the premises, venue, accommodation or other service. We will have no further responsibility toward such person(s) including any returns. No refunds will be made and we will not pay any expenses or costs incurred as a result of the termination.
Contracts:
- Beyond The Blue Limited reserves the right to change the content of courses and services to meet the needs of the client, service, legislation and Beyond The Blue Limited without notice. Consultation and communication with the client(s) will always be entered into where possible.
Our Liability to You:
- We will make every effort to make sure that the arrangements we have agreed to make, perform or provide as applicable as part of our contract with you are made, performed or provided with reasonable skill and care. Please note it is your responsibility to show that reasonable skill and care has been used by you at all times. In addition, we will only be responsible for what our employees, agents and suppliers do or do not do if they were at the time acting within the course of their employment (for employees) or carrying out work we had asked them to do (for agents and suppliers). We will not be responsible for any injury, illness, death, loss (for example loss of enjoyment), damage, expense, cost or other sum or claim of any description whatsoever which results from any of the following:-
a. the act(s) and/or omission(s) of the person(s) affected or any member(s) of their party or
b. the act(s) and/or omission(s) of a third party not connected with the provision of your course/service and which were unforeseeable or unavoidable or
c. “force majeure” as defined above (“Refunds” point 7).
- We cannot accept responsibility for any services which do not form part of our contract. This includes, for example, any additional services or facilities which your training facility or any other supplier agrees to provide for you, where the services or facilities are not advertised in our brochure or on our website and we have not agreed to arrange them. In addition, regardless of any wording used by us on our website, in any of our brochures or elsewhere, we only promise to use reasonable skill and care as set out above and we do not have any greater or different liability to you.
- Please note, we cannot accept any liability for any damage, loss, expense or other sum(s) of any description which on the basis of the information given to us by you concerning your booking prior to our accepting it, we could not have foreseen you would suffer or incur if we breached our contract with you or which did not result from any breach of contract or other fault by ourselves or our employees or, where we are responsible for them, our suppliers. Additionally we cannot accept liability for any business losses.
Privacy Policy:
- Beyond The Blue Limited is committed to protecting your privacy and the confidentiality of information provided to us as regulated by the data protection act. The information you provide is necessary to enable the processing of your registration and updating your current records with us. The information will be used to contact you regarding registrations, cancellations and to provide you with information about your booking. It may also be used to inform you of a range of current and future services, opportunities and other prospective events from Beyond The Blue Limited that may be of interest to you. Please note Beyond The Blue is not a company the sends out prolific marketing materials or e-mails to unsolicited individuals and uses details only to provide specific information related to the company and the course or subject matter for which you registered.
- Information provided by you will not be disclosed to any third party with the exception of the registered accredited training organisation, for quality audit and examination assessment requirements or where we are legally bound.
- Individuals may opt out of receiving marketing material by ticking the appropriate box during the booking process.
